Terms and Conditions of the Freesat GHOULISHLY GOOD 2024 Prize Draw
By entering the prize draw (“Prize Draw”), you agree that you have read and understood these terms and conditions and agree that you will be bound by them.
1. The Promoter
1.1. The promoter is Everyone TV Platforms Limited, Triptych Bankside, 185 Park Street, London SE1 9SH - Company Number: 09880917 (the “Promoter, “Freesat”).
2. The Prize Draw
2.1. The title of the Prize Draw is called Freesat Halloween 2024 Prize Draw.
2.2. The Prize Draw provides the chance for two (2) winners (“Winners”) to win either:
2.2.2. One (1) person to win one (1) LEGO Hidden Side 70425 – Newbury Haunted High School, Ghost Construction Toys Set (total value £119.99)
(1st Bundle Option “Prize”);
2.2.3. One (1) person to win one (1) Fortnum & Mason The Wicked Wicker Halloween Hamper, Limited Edition (total value £75) (2nd Bundle Option “Prize”)
(together the “Prizes”).
2.3. The Promoter cannot take responsibility for any lost Prizes and replacements cannot be issued.
3. Entry Period
3.1. The Prize Draw entry period runs from 13:00 GMT Friday 25th October 2024 (the “Start Date”) until 16:00 GMT on Thursday 31st October 2024 (the “Closing Date”) (together the “Entry Period”).
3.2. No entry will be counted before or after the Entry Period. All entries received after the Closing Date will be disqualified.
4. How to Participate
4.1. To enter the Prize Draw participants must go to https://www.freesat.co.uk/halloween and submit their first name, last name,email address, and confirm their choice of prize in the form.
4.2. Only one (1) entry per person is permitted.
4.3. If participants do not provide any of the mandatory information requested according to paragraphs 4.1 and 4.2 when participating in the Prize Draw, their entry will be void.
4.4. Access to the internet is required.
4.5. Freesat will not accept:
4.5.1 responsibility for Prize Draw entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.
4.5.2. Proof of transmission as proof of receipt of entry to the Prize Draw
4.6. By submitting an entry form, you are agreeing to be bound by these terms and conditions.
5. Eligibility
5.1. The Prize Draw is open to residents of the United Kingdom (England, Scotland, Wales and Northern Ireland only), aged (eighteen) 18 and over.
5.2. Only one (1) entry per person will be accepted.
5.3. The Prize Draw is not open to:
5.3.1. employees of Freesat or its holding or subsidiary companies;
5.3.2. employees of agents or suppliers of Freesat or its holding or subsidiary companies, who are professionally connected with the Prize Draw or its administration; or
5.3.3. members of the immediate families or households of paragraphs 5.3.1 and 5.3.2 above.
5.4. No applications from agents, third parties, organised groups or applications automatically generated by computer will be accepted.
5.5. In entering the Prize Draw, you confirm that you are eligible to do so and eligible to claim the Prize. Freesat may require you to provide proof that you are eligible to enter the Prize Draw.
5.6. In the event that you do not, or are unable to, comply with the terms and conditions, Freesat shall be entitled at its discretion to disqualify you, without any further liability.
6. The Winners
6.1. The decision of Freesat is final and no correspondence or discussion will be entered into.
6.2. The Winners will be selected at random by way of computer process by Freesat. There will be one two (2) Winners in total, one (1) for each Prize.
6.3. The Winners will be notified by the Promoter by email within three (3) days of the Prize Draw Closing Date.
6.4. In order to claim their Prize, Winners must respond appropriately and within three (3) days following the Promoter’s email notification (“Claim Period”), and provide their full name, postal address and contact telephone number.
6.5. If the Promoter has not received a response from a Winner during the Claim Period, or if any of the requirements set out in these terms and conditions are otherwise not met in respect of a Winner, the Promoter reserves the right to select a new Winner in accordance with paragraph 6.4. above. The Winner will receive the Prize within thirty (30) days from the Prize Draw Closing Date.
6.6.The Prize may not be claimed by a third party on your behalf.
6.7. Freesat does not accept any responsibility if you are not able to take up the Prize or you provide incorrect details.
7. Limitation of Liability
7.1. Insofar as is permitted by law, Freesat, its agents or distributors will not in any circumstances be responsible or liable to compensate the Winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking part in the Prize Draw, except where it is directly caused by the negligence of Freesat, its agents or distributors or that of its employees. Your statutory rights are not affected.
7.2. No liability will be accepted for any entries not received, or not received in the Entry Period due to internet or other errors or failures. No incomplete, delayed or corrupted entries will be accepted.
8. Data Protection and Publicity
8.1. Personal data supplied during the course of this Prize Draw will only be processed by the Promoter as set out in the Promoter’s Privacy Notice
8.2. In order to show that a valid award took place:
8.2.1. The first names and first initial of surnames of the Winners may be published on the Promoter’s social media accounts (Facebook, Instagram and Twitter) and in the Promoter’s email newsletter sent to customers; and
8.2.2. The surnames and counties of residence of the Winners will be available from the Promoter on reasonable request to those enclosing a self-addressed envelope marked “Freesat Halloween 2024 Prize Draw” to the following address: Everyone TV Platforms Limited, Triptych Bankside, 185 Park Street, London SE1 9SH. Requests must be received within one (1) month of the Closing Date.
8.3. By submitting your entry form, you are agreeing to the use and publication of your details in the manner described in paragraphs 8.2.1. and 8.2.2. above.
8.4. In the event that you are a Winner, and you object to your details being published or made available, please send an email to digital@everyonetv.co.uk. Please note that Freesat must still provide the information and winning entries to the Advertising Standards Authority on request.
9. General
9.1. The number of one hundred (100) channels correct at time of the Prize Draw.
9.2. The Promoter reserves the right to amend or withdraw the Prize Draw, temporarily or permanently, with or without prior notice, if deemed necessary due to circumstances beyond its reasonable control (including, without limitation, in the case of anticipated, suspected or actual breach of these terms and conditions.
9.3.This Prize Draw is in no way sponsored, endorsed or administered by, or associated with, Instagram, Facebook, Twitter, LEGO, or Fortnum & Mason.
9.4. The Prize Draw is governed by the laws of England and will be subject to the exclusive jurisdiction of the English Courts.
9.5. If any court or competent authority finds that any provision of these terms and conditions (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these terms and conditions shall not be affected.
